Custom & Personalized Products Policy
Many SP RHODES products are designed, embroidered, printed, manufactured, sewn, fabricated, or otherwise customized specifically for an individual customer, farm, team, business, horse show, sponsor, retailer, or organization.
This policy explains the terms that apply to custom, personalized, made-to-order, OEM, private-label, and specially produced goods. Please review it carefully before approving artwork or placing a custom order.
Once artwork has been approved and production has begun, custom, personalized, embroidered, printed, altered, fabricated, OEM, and made-to-order products generally cannot be cancelled, returned, or exchanged except where the product is defective, materially differs from the approved specifications, or otherwise as required by applicable law.
Products Covered by This Policy
This policy applies to any product or service that is produced, decorated, altered, configured, sourced, or manufactured specifically for a customer or according to customer-selected specifications.
Examples include, but are not limited to:
Logos, names, monograms, sponsor marks, farm branding, embroidery placement, and custom thread colors.
Branded jackets, shirts, hats, outerwear, team apparel, riding apparel, staff uniforms, and promotional merchandise.
Saddle pads, blankets, coolers, stable accessories, horse equipment, and other customized equestrian products.
Stall drapes, signs, banners, whiteboards, stall plates, furniture, displays, and branded show materials.
Farm signs, property signs, lightbox signs, dimensional signage, plaques, branded panels, and other fabricated sign products.
Custom trophies, ribbons, coolers, presentation products, commemorative items, and branded awards.
Custom-manufactured products, wholesale goods, private-label merchandise, custom packaging, and production runs.
Products ordered in non-standard colors, dimensions, quantities, materials, finishes, or configurations specifically for a customer.
Placing a Custom Order
Customers are responsible for providing complete and accurate information when requesting or placing a custom order.
Depending on the product, this may include:
- Customer name, company, farm, team, or organization;
- Product type and quantity;
- Size or dimensional requirements;
- Product colors;
- Fabric, material, finish, or construction preferences;
- Embroidery or decoration location;
- Logo or artwork files;
- Thread, print, paint, vinyl, or material colors;
- Personalization details;
- Packaging requirements;
- Delivery requirements; and
- Any date by which the product is requested.
SP RHODES may request additional information before an order can proceed into design, proofing, sampling, or production.
Customer-Supplied Artwork & Intellectual Property
Customers may provide logos, trademarks, names, photographs, artwork, graphics, illustrations, text, or other materials for use in connection with a custom order.
By providing these materials to SP RHODES, the customer represents and warrants that the customer owns the materials or has obtained all permissions, licenses, consents, and rights necessary for SP RHODES to reproduce, modify, digitize, embroider, print, manufacture, display, or otherwise use them for fulfillment of the customer's order.
The customer agrees not to submit materials that infringe or misappropriate the copyright, trademark, publicity, privacy, or other rights of any third party.
SP RHODES may decline to reproduce artwork that we reasonably believe may violate law, infringe third-party rights, contain unlawful content, or otherwise create legal or reputational risk.
Customer artwork may require resizing, simplification, digitizing, vector conversion, color adjustment, separation, recreation, or other production preparation. Such preparation may result in reasonable differences from the original digital artwork because embroidery, weaving, printing, fabrication, and manufacturing processes each have their own technical limitations.
Design, Digitizing & Setup Charges
Certain custom orders may require artwork preparation, embroidery digitizing, machine setup, sampling, pattern development, tooling, mold preparation, printing setup, color matching, or other pre-production services.
Where applicable, these charges may be quoted separately from the cost of the finished product.
Design, artwork, digitizing, sampling, development, and setup charges compensate SP RHODES for work already performed and may therefore be non-refundable once that work has begun.
Digital Proofs & Customer Approval
When a proof is provided, the customer is responsible for reviewing it carefully before approval.
The customer should verify all relevant details, including:
- Spelling;
- Names and initials;
- Logo orientation;
- Artwork;
- Colors;
- Dimensions;
- Placement;
- Proportions;
- Quantity;
- Product style;
- Personalization; and
- Any other project-specific details shown on the proof.
SP RHODES is not responsible for errors that appear on an approved proof and are reproduced accurately in the finished product, including spelling errors, incorrect names, approved dimensions, approved color selections, or approved artwork placement.
Revisions & Changes
Reasonable revisions may be permitted during the proofing process depending on the product and project.
If a quoted project includes a specified number of revisions, additional revisions may be subject to additional design or production charges.
Requests to change artwork, colors, quantities, sizes, materials, dimensions, decoration, personalization, or other specifications after approval may:
- Result in additional charges;
- Require a new proof;
- Delay production;
- Require replacement materials or products;
- Require a new production minimum; or
- Be impossible once production has begun.
Colors & Digital Representations
Colors displayed on websites, digital proofs, monitors, phones, tablets, photographs, PDFs, and other electronic devices are representations only.
Screen calibration, lighting, photography, material composition, dye lots, print processes, fabric texture, thread construction, paint, vinyl, wood, metal, and manufacturing methods may cause physical colors to appear different from their digital representation.
Where color charts, fabric books, thread charts, paint samples, Pantone references, yarn samples, or physical material samples are available, those physical production references should be considered more accurate than a screen representation.
Reasonable color variation is inherent in customized manufacturing and does not by itself constitute a defect.
Materials & Natural Variation
Certain SP RHODES products incorporate natural or manufactured materials that may vary from one piece or production lot to another.
These may include wood, leather, fabric, yarn, thread, metal, plastics, coated materials, printed materials, paint, vinyl, textiles, and other production components.
Grain, texture, weave, sheen, surface appearance, dye lot, tone, thickness, finish, and other minor variations may occur and are considered normal characteristics of custom production unless otherwise expressly agreed in writing.
Production Tolerances
Custom manufacturing involves processes that may produce minor variations between individual pieces.
Reasonable production tolerances may include variations in:
- Embroidery placement;
- Stitching;
- Logo size;
- Print alignment;
- Color;
- Fabric dimensions;
- Finished product dimensions;
- Cutting and sewing;
- Hardware placement;
- Wood grain or finish;
- Sign fabrication;
- Packaging; and
- Other manufacturing characteristics.
Minor variations that fall within normal manufacturing tolerances and do not materially impair the intended use of the product are not considered defects.
Sizing & Measurements
Customers are responsible for reviewing available sizing information and selecting appropriate sizes before production.
Sizing may vary between manufacturers, products, styles, materials, and production runs. A size designation from one manufacturer should not be assumed to be identical to the same designation from another.
If SP RHODES provides dimensions, sizing charts, measurement guidance, or samples, they are intended to assist the customer in making a selection but do not replace the customer's responsibility to confirm that the selected specification is appropriate for the intended use.
Samples & Pre-Production Samples
Certain OEM, wholesale, private-label, or complex custom projects may offer or require a pre-production sample.
Samples may be subject to separate charges, setup fees, shipping charges, or extended production timelines.
Unless expressly included in the quotation, production of a sample is not included automatically with every custom order.
A production run may contain reasonable manufacturing variations from a sample due to material batches, production processes, manufacturing tolerances, or scale of production.
Production Time
Production timelines for custom goods vary based on product type, quantity, complexity, material availability, customization method, supplier availability, season, and production capacity.
Unless SP RHODES expressly confirms a guaranteed delivery date in writing, production and delivery timeframes are estimates.
Production time generally begins only after all required conditions have been satisfied, which may include:
- Receipt of required payment or deposit;
- Receipt of complete artwork;
- Approval of artwork or proof;
- Approval of colors and materials;
- Confirmation of quantities and sizing;
- Receipt of any customer-supplied items; and
- Resolution of outstanding project questions.
Customer Approval Delays
Delays in providing artwork, information, payment, selections, feedback, or proof approval may result in corresponding changes to the estimated production or delivery schedule.
A production slot or estimated completion date cannot necessarily be held while approval or required information remains outstanding.
Rush Orders & Event Deadlines
Customers with a horse show, competition, event, opening, sponsorship activation, retail launch, or other fixed deadline should disclose that date before placing the order.
Rush service may be available for certain products and may require an additional fee.
Acceptance of an order with a requested event date does not create a guaranteed delivery obligation unless SP RHODES expressly confirms that guarantee in writing.
Quantities & Minimum Orders
Certain products, particularly OEM, private-label, wholesale, manufactured, woven, printed, or specially sourced products, may have minimum order quantities.
Minimum quantities may apply by product, color, size, artwork, design, packaging type, or production run.
Where manufacturing processes result in minor production overages or shortages, applicable quantity tolerances will be communicated where relevant to the project.
OEM, Private-Label & Wholesale Production
OEM and private-label projects may involve third-party factories, specialist manufacturers, mills, embroiderers, printers, packaging suppliers, freight providers, or other production partners.
These projects may be subject to additional requirements including:
- Minimum order quantities;
- Sample charges;
- Tooling or development fees;
- Production deposits;
- Balance payments prior to shipment;
- Material minimums;
- Packaging minimums;
- Factory tolerances;
- Quantity tolerances;
- Freight and customs charges;
- Longer lead times; and
- Product-specific manufacturing requirements.
Any project-specific quotation, purchase order, invoice, production approval, or written agreement may contain additional terms that supplement this policy.
Custom Packaging
Optional custom packaging may be available for certain OEM, wholesale, gift, award, retail, and private-label products.
Custom packaging may require separate artwork approval, minimum quantities, setup charges, additional production time, and additional freight.
Packaging shown in photographs, renderings, or samples may differ slightly from finished production due to material, printing, manufacturing, or supplier variations.
Material Availability & Substitutions
Custom products may depend upon the availability of specific fabrics, garments, thread, yarn, components, hardware, substrates, finishes, packaging, or other materials.
If a selected material becomes unavailable before production, SP RHODES will use reasonable efforts to offer an appropriate alternative or obtain customer approval for a material change where the change is material to the appearance or function of the product.
Cancellations
Because customized goods require design work, material commitments, product sourcing, setup, scheduling, and production specifically for the customer, cancellation rights are limited.
If production has not begun and no non-recoverable costs have been incurred, SP RHODES may be able to accommodate cancellation or modification of the order.
Once materials have been ordered, artwork has been prepared, goods have been decorated, manufacturing has begun, or other non-recoverable costs have been incurred, the order may no longer be eligible for cancellation.
Any refund associated with an approved cancellation may be reduced by design fees, setup fees, digitizing fees, material costs, sampling charges, supplier charges, freight, payment-processing expenses where legally permissible, or other costs already incurred specifically for the order.
Returns & Exchanges
Because these products are created specifically to the customer's selections and generally cannot be resold, custom products are ordinarily not eligible for return or exchange because of a change of mind, incorrect customer-selected size, approved color, approved personalization, approved design, or other preference confirmed before production.
Florida's retail refund statute specifically excludes goods that are custom made or custom altered at the customer's request from its general refund-policy requirements.
Nothing in this policy is intended to eliminate any right or remedy that cannot legally be excluded.
Defective or Incorrect Custom Products
If you believe a custom product is defective, damaged, incorrectly produced, or materially different from the approved specification, please contact SP RHODES promptly after delivery.
We may request photographs, measurements, packaging photographs, order information, or return of the affected item so that we can evaluate the concern.
If SP RHODES determines that an item contains a manufacturing error attributable to SP RHODES or does not materially conform to the approved order, we will determine an appropriate remedy based on the circumstances, which may include repair, correction, replacement, remake, credit, or refund where appropriate and required by applicable law.
Shipping Damage & Delivery Issues
Customers should inspect custom products promptly after delivery.
If a shipment appears damaged, retain the shipping carton, packaging materials, labels, and damaged goods and contact SP RHODES promptly.
Photographs may be required to support a carrier claim or determine an appropriate resolution.
Shipping and freight claims may also be subject to the terms of our separate Shipping & Delivery Policy.
Customer-Supplied Products or Materials
In some circumstances, SP RHODES may agree to embroider, print, decorate, alter, or otherwise work on products or materials supplied by the customer.
Decoration and production processes inherently involve some risk. Where SP RHODES accepts customer-supplied goods, customers should not provide irreplaceable, one-of-a-kind, sentimental, or unusually valuable items unless specifically agreed in writing.
Any special terms applicable to customer-supplied goods may be communicated before accepting the project.
Deposits & Payment
SP RHODES may require full payment, a deposit, or another agreed payment arrangement before design work, sourcing, sampling, manufacturing, or production begins.
Certain OEM, wholesale, or large custom projects may require staged payments.
Unless otherwise agreed in writing, final balances may be required before shipment or release of finished goods.
Quotes & Estimates
Quotations are based on the specifications, quantities, materials, artwork, packaging, and information available at the time the quote is prepared.
Changes to the project may result in revised pricing.
Unless otherwise stated, quotations do not necessarily include shipping, freight, customs duties, brokerage, taxes, special packaging, rush fees, installation, or services not expressly identified in the quotation.
Product Photography & Portfolio Use
SP RHODES may photograph products we create for quality-control, production, portfolio, promotional, archival, or marketing purposes, subject to applicable confidentiality obligations and any separate written agreement with the customer.
If a project is confidential, unreleased, subject to an embargo, or should not be publicly displayed, the customer should notify SP RHODES in writing before production.
Confidential & Unreleased Projects
Customers working on confidential launches, sponsorships, unreleased branding, private-label collections, or other sensitive projects should identify confidentiality requirements before supplying artwork or production information.
Where additional confidentiality obligations are required, they should be established through a separate written agreement.
Events Outside Our Reasonable Control
Custom production may be affected by events outside the reasonable control of SP RHODES, including carrier disruptions, supplier delays, factory closures, severe weather, natural disasters, labor disputes, customs delays, transportation interruptions, shortages, equipment failures, governmental actions, or similar events.
When such circumstances occur, SP RHODES will use commercially reasonable efforts to communicate material delays and complete the order as soon as reasonably practicable.
Relationship to Quotes, Invoices & Other Terms
This Custom & Personalized Products Policy should be read together with the SP RHODES Terms & Conditions, Shipping & Delivery Policy, Returns & Refunds Policy, Privacy Policy, and any applicable quotation, invoice, purchase order, proof approval, or project agreement.
A project-specific written agreement may supplement this policy. Where expressly stated and legally permitted, project-specific written terms may control over inconsistent general provisions.
